Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

Termination

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected. Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. Termite Control and Warranty Agreement

This agreement covers the termite inspection, treatment, and any warranty or service plan Right Time Termite Company provides for your property in Pasadena, CA, and it applies alongside the general Terms and Conditions posted elsewhere on this website. Booking service means you accept both. Because termite work usually runs from an inspection to a treatment and then to ongoing protection, the notes below explain each stage and what it depends on.

Booking Inspections, Treatments, and Renewals

Right Time Termite Company makes reasonable efforts to perform inspections, treatments, and any follow-up or annual renewal visits at the times agreed during booking. These visits are arranged in sequence so the home can be inspected, treated, and protected properly. Scheduling depends on availability and can shift with access, weather, building coordination, technician availability, or other operational factors. We give you as much notice as possible of any meaningful change. For real estate and time-sensitive requests we respond as quickly as we can, but cannot promise exact timing.

Reaching the Areas We Treat

You are responsible for making the areas that need inspection and treatment accessible on the service date. That can include the foundation perimeter, crawl spaces, basements, attics, garages, and interior wall lines. A liquid barrier treatment may mean trenching soil along the foundation and, where concrete adjoins it such as a slab, patio, or garage floor, drilling and later patching small holes to treat beneath it. If a whole-structure fumigation is the method recommended for your situation, you must vacate the structure for the required period and follow all preparation instructions, including removing or bagging food, medicine, plants, and pets as directed. Areas blocked by stored items, heavy clutter, or locked enclosures may need extra time and can carry the fees described below.

What a Standard Termite Service Covers

A standard service starts with an inspection to confirm whether termites are active, what type they are, and how far they have spread, followed by treatment using the method that fits the situation, which may include a liquid termiticide barrier, in-ground bait and monitoring, wood or spot treatments, a whole-structure fumigation where appropriate, or a combination, along with any follow-up and the warranty or service agreement included in your plan. When the work is done, you receive documentation of the service date, the areas treated, the method used, and any recommendations. A wood-destroying organism (WDO) report prepared for a real estate transaction reflects the conditions visible and accessible on the inspection date and is not a guarantee against hidden or future activity.

Work Quoted Separately

A standard termite service does not include control of unrelated pests such as mosquitoes, bed bugs, cockroaches, rodents, or wasps, or general pest control. A WDO inspection may note other wood-destroying organisms such as carpenter ants, wood-boring beetles, or wood-decay fungus, but treating those is quoted on its own. Structural or wood repair is not included unless agreed in writing.

Products, Re-Entry, and Sensitive Households

All products and methods Right Time Termite Company uses are applied according to their label directions and the applicable local, state, and federal rules. People and pets should stay out of treated areas as directed until applications have dried or, after a fumigation, until the licensed professional performing the work has cleared the structure for re-entry. Please tell us before service about known allergies, chemical sensitivities, wells or water features, and any sensitive people or pets, so we can take reasonable precautions. Right Time Termite Company is not responsible for reactions that arise from undisclosed sensitivities or from not following re-entry guidance.

Conditions That Postpone Service

Right Time Termite Company may decline or postpone a visit when site conditions are unsafe or unsuitable, or when required preparation is not complete. That includes hazardous materials in the work area, unsafe electrical or structural conditions, standing water, aggressive or unsecured animals, or an inability to safely reach the areas to be treated. Rescheduling caused by these conditions may carry a trip charge or rescheduling fee.

Soil, Landscaping, and Treated Surfaces

Termite treatment can involve the foundation, soil, crawl spaces, and interior and exterior walls, and may require the trenching and drilling described above. Right Time Termite Company takes reasonable care to limit disturbance, but you acknowledge that some disturbance to soil, foundation-side landscaping, or treated concrete can happen as a normal part of the work. Right Time Termite Company is not responsible for pre-existing damage, for incidental disturbance to landscaping, sprinkler lines, or unmarked underground features near the treatment area, or for conditions that were hidden or inaccessible during inspection. If you want any such features flagged before the service date, please mark them ahead of time.

Warranty, Re-Treatment, and Why Results Vary

If your plan includes a warranty or service agreement, you may request re-treatment under the terms of that agreement, and Right Time Termite Company will make reasonable efforts to respond promptly. Ongoing coverage generally requires an annual renewal and inspection to stay in effect. Results depend in part on the type and extent of the infestation, the construction and condition of the structure, moisture and other conducive conditions on or near the property, and following the recommendations we provide. A warranty or service agreement is a service commitment, not a structural-repair guarantee, unless repair coverage is stated in writing.

Charges Beyond the Standard Service

Additional charges may apply for the following:

  • Larger homes, additional linear footage, or extensive or hard-to-reach infestations
  • Hard-to-access areas, heavily cluttered spaces, or limited crawl-space access
  • Trip charges for inaccessible, unsafe, or unprepared sites
  • Rescheduling on short notice or visits where preparation was not finished
  • Whole-structure fumigation and severe-infestation work
  • Annual renewal of a warranty or service agreement

Wherever practical, we tell you about added charges before doing the extra work, and they are invoiced under the terms Right Time Termite Company provides.

Payment

Unless agreed otherwise in writing, payment is due when the service is complete, or on the schedule set for a multi-step treatment or a warranty or service agreement. Right Time Termite Company accepts the payment methods shared at booking. If you dispute a charge, raise it with Right Time Termite Company within a reasonable time so we can review it against the service documentation and technician notes.

Your Acknowledgment

By scheduling termite control service with Right Time Termite Company, the customer acknowledges that they have read, understood, and agreed to these specific service terms in addition to the general Terms and Conditions provided on this website. When demand is high or schedules conflict, Right Time Termite Company reserves the right to subcontract or coordinate service fulfillment through a trusted third-party provider. Non-compliance with these terms may result in service refusal, rescheduling, or additional charges.

When a Partner Provider Steps In

Because of capacity limits, scheduling conflicts, or service availability, Right Time Termite Company may connect customers with independent third-party termite control providers to fulfill a request. When this happens, the third-party provider is an independent contractor and not an employee or agent of Right Time Termite Company. The customer is responsible for verifying that any provider hired holds the licenses, insurance, and permits required for the work in their jurisdiction.

This site is a free service to assist homeowners in connecting with local service contractors. All contractors are independent and this site does not warrant or guarantee any work performed. It is the responsibility of the homeowner to verify that the hired contractor furnishes the necessary license and insurance required for the work being performed. All persons depicted in a photo or video are actors or models and not contractors listed on this site.
